HOW IT WORKS - SELF OPTION
Step 1: You use our easy to use, questionnaire to determine if you qualify to have your case sealed or expunged. If you don’t feel comfortable using the questionnaire, you can pay our office low price of $50 per case, to determine if you qualify.
Step 2: You pay our fee for the creation of your petition, and proposed order.
Step 3: We verify that you qualify, and obtain the appropriate information about your case from you, and the County or District Clerk.
Step 4: We draft your petition and proposed order and send it to you for your review.
Step 5: You confirm that all of the information in the documents is correct.
Step 6: We send you the final version of your documents for filing.
Step 7: You file your petition with your County or District Clerk, and pay the appropriate filing fee. If you cannot afford to pay the filing fee, you are able to file an Affidavit of Indigency to waive the filing fee.
Step 8: You send a copy of your petition to the Assistant District Attorney that handles expunctions and/or non-disclosures, for the county that your case is in. In your email, you will ask the Assistant District Attorney if they are opposed or unopposed to your request.
Step 9: You contact the court to determine if a hearing needs to be scheduled for your petition. Each court is different and each case is different. Some courts schedule the hearing after you receive a response from the State. Some courts don’t require a hearing if the state is unopposed to your petition. Other courts require a hearing and will allow you to schedule your hearing when you file your petition.
Step 10: If your petition is set for a hearing, you must attend the hearing, unless the court does not require your appearance. At the hearing the court will determine if you qualify, and hear from any party that opposes your petition.
Step 11: The judge signs the Order granting your petition for non-disclosure or expunction.
Step 12: CONGRATULATIONS! You will receive a copy of your signed Order. We recommend that you request at least one certified copy of the Order, and store the copy in a safe place.
